Terms and Conditions

1. About Leap

Leap Technologies ("Leap", "we", "us") runs a platform that helps people find homes and business spaces to lease, apply online, make offers, and helps owners and agents review applicants. These terms apply to everyone who uses Leap, including the website, mobile web app and any related services (the "Service").

By creating an account or using the Service, you agree to these terms and to our handling of personal information described in section 8. If you don't agree, please don't use Leap.

2. What Leap is, and isn't

Leap is a technology platform. Unless we say otherwise in writing, Leap is not a landlord, property manager, real estate brokerage or party to any lease. Leases are agreements between renters and owners (or their agents). Leap does not guarantee that any listing is available, accurate, or that any application will be accepted.

Where a listing comes from the MLS® System, requests are handled by a licensed real estate professional who works with Leap, as described in section 7.

3. Your account

  • You must be at least 18 years old and able to enter into a binding contract.
  • Give accurate information and keep it up to date. Applications built on false information may be withdrawn or declined.
  • Keep your password private. You are responsible for activity on your account. Tell us right away at support@leap.homes if you think someone else has accessed it.
  • One person per account. Owners and agents may only list properties they are authorized to lease.

4. For renters

  • Applications. When you apply or send a request, you authorize Leap to share your profile (identity, contact, employment, income, household details, references, your message and your offer) with the owner or agent for that property.
  • Offers. Some listings accept offers above the asking rent. An offer is a statement of what you are willing to pay and becomes binding only when you sign a lease. You can raise or withdraw an offer until the owner makes a decision. Never offer more than you can comfortably afford.
  • No fees from Leap. Leap does not charge renters to apply. Never send a deposit or rent to anyone before you have viewed the property (in person or by verified video) and signed a lease. Report suspicious requests to us.
  • Your rights. Nothing on Leap changes your rights under the residential tenancy laws of your province or territory (for example Ontario's Residential Tenancies Act, 2006, or British Columbia's Residential Tenancy Act), including rules about deposits, rent increases and lease forms.

5. For owners and agents

  • Accurate listings. Listings must describe real, available properties you are authorized to lease, with honest photos, rent and terms. Remove or mark a listing leased as soon as it is no longer available.
  • Fair selection. You must comply with the human rights legislation of your province or territory and all applicable laws. You may not refuse, rank or treat applicants differently because of race, ancestry, place of origin, colour, ethnic origin, citizenship, creed, sex, sexual orientation, gender identity or expression, age, marital or family status, disability or receipt of public assistance. Income, credit history and references may only be used as permitted by law.
  • Offers. If you open a listing to offers, you agree to consider offers in good faith and not to use fake or shill offers. Rent and deposits must follow the residential tenancy laws where the property is located.
  • Applicant information. Use applicant information only to evaluate their application for that property. Don't copy, sell or share it, and delete it when you no longer need it for that purpose.
  • Agents confirm they are licensed with the real estate regulator in their province (such as RECO in Ontario, BCFSA in British Columbia, RECA in Alberta or the OACIQ in Quebec) where required, and follow its rules.

6. Credit checks

An owner or agent may require a credit check for a property. We will only run one after you give express consent in the app for that specific application. Checks are soft inquiries and do not affect your credit score. The owner or agent sees a summary (score, score band, number of accounts, utilization, late payments and collections), not your full report.

Credit checks are run through our credit reporting partner. You can ask us which partner handled your report and how to obtain your own report from Equifax Canada or TransUnion Canada.

7. MLS® listings

Some listings on Leap are provided through licensed MLS® data feeds (such as the REALTOR.ca DDF® and regional real estate boards' IDX feeds) under the sponsorship of a member brokerage. MLS® listing content belongs to the listing brokerage and the real estate board, is shown as provided, and is deemed reliable but not guaranteed. It may only be used for your personal, non-commercial search for a place to lease. You may not copy, scrape or redistribute it.

When you send a request on an MLS® listing, your offer and profile go to a licensed real estate professional who works with Leap, who presents it to the listing brokerage. The listing brokerage and owner decide whether to accept it.

The trademarks MLS®, Multiple Listing Service® and the associated logos are owned by The Canadian Real Estate Association (CREA) and identify the quality of services provided by real estate professionals who are members of CREA. The trademarks REALTOR®, REALTORS® and the REALTOR® logo are controlled by CREA and identify real estate professionals who are members of CREA.

8. Privacy and activity records

We collect the information you give us and information about how you use Leap (for example sign-ins, applications, offers, device type and IP address) to run the Service, prevent fraud, keep records of applications, and help our support team when you need it. We handle personal information in line with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA).

We share your information only as described in these terms, with service providers who help us run Leap, or where the law requires. You can ask to access or correct your information, or close your account, by writing to support@leap.homes.

9. Things you can't do

  • Post fake, misleading or duplicate listings, or listings for properties you can't lease.
  • Use Leap to scam, harass or discriminate against anyone.
  • Collect other users' information, or scrape, copy or resell listings or data from Leap.
  • Interfere with the Service, try to access accounts or data that aren't yours, or get around security or usage limits.

10. Suspension and closing accounts

We may suspend or close accounts, or remove listings and applications, that break these terms or put other users at risk. You can close your account at any time by contacting us. Some records may be kept where the law requires or to resolve disputes.

11. Disclaimers and limits of liability

Leap is provided "as is". We work hard to keep it accurate and available, but we don't promise it will be error-free or uninterrupted, and we don't verify every listing or user. View properties and confirm details before signing a lease or paying money.

To the extent the law allows, Leap is not liable for indirect or consequential losses, or for the acts of owners, agents, renters or other users. Our total liability for any claim related to the Service is limited to the greater of $100 or the amount you paid Leap in the 12 months before the claim. Nothing in these terms limits rights you have under consumer protection law that cannot be waived.

12. Changes, governing law and contact

We may update these terms as Leap grows. If we make material changes, we will let you know in the app or by email before they take effect. Continuing to use Leap after that means you accept the new terms.
